Terms of Service
1. Who these terms are between
This website is operated by Upside Property, LLC | Upside Realty, LLC ("Upside", "we", "us"), a licensed real estate and property management business in South Carolina. By using this website you agree to these terms. If you do not agree with them, please do not use the site.
2. What this website is
This website is an information and enquiry service. It is how you find out about our services and get in touch with us. It is not a brokerage transaction platform, and nothing on it completes a sale, lease, rental agreement, or management agreement.
3. No professional advice
Content on this website is general information, not advice. Nothing here is legal, tax, accounting, financial, lending, or investment advice, and it is not an appraisal. For advice about your own circumstances, speak to a qualified professional — and for anything affecting a transaction, speak to us directly.
4. Valuations, estimates and the automated assistant
Any figure shown on this website is an estimate, not an appraisal, and it is not a market valuation. In particular:
- Home value ranges are indicative only. They are a benchmark drawn from the listings held for that market at the time, at their asking price per square foot, adjusted for the details you enter. They are not a comparable-sales analysis and they are not a valuation. Where we do not hold enough data for your market, we show no figure at all rather than a guess.
- The landlord calculator produces illustrative estimates from the reference rates published on this site. It is not a quote, a rent guarantee, or a projection of your actual return.
- The AI assistant is deliberately built not to state prices, rents, availability, or appointment times, because it has no access to that data. It helps qualify and route your enquiry. A person confirms every detail before anything is relied upon.
Do not make a financial decision on the basis of an automated figure from this website. Ask us for a written analysis and we will prepare one.
5. Listings, availability and sample content
Property information on this website is provided for general information and may change without notice. Inventory shown may include sample or illustrative listings pending connection to a live listing feed, and pages carrying that label are marked as such. Nothing on this website is an offer to sell or to lease, or a solicitation of an offer, where prohibited by law. Availability, pricing, fees and terms are confirmed by us in writing.
We are committed to fair housing. We do not discriminate, and will not discriminate, on the basis of race, colour, religion, sex, handicap, familial status, national origin, or any other protected characteristic.
6. Your responsibilities
When you submit information through this website you confirm it is accurate and that you are entitled to provide it — including that you are the owner of, or authorised to act for, any property you ask us about. You agree not to misuse the site: no attempting to access information belonging to others, no interfering with its operation, no scraping or bulk harvesting, no automated submissions, and no uploading anything unlawful or infringing.
7. Our content
The design, text, graphics, photography and code of this website belong to us or are used with permission, and are protected by copyright and other rights. You may view and print pages for your own personal, non-commercial use. You may not copy, republish or redistribute material from this website without our written permission.
8. Links to other sites
This website links to services we do not control — for example the resident portal, and third-party forms. We are not responsible for those sites or their terms.
9. Availability and accuracy
We try to keep this website accurate and available, but we provide it "as is" and "as available", without warranties of any kind to the fullest extent the law allows. We do not warrant that it will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current. Third-party data and automated estimates are inherently approximate.
10. Limitation of liability
To the fullest extent permitted by law, Upside is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost opportunities, arising out of your use of this website. Nothing in these terms limits any liability that cannot lawfully be limited, or affects your statutory rights.
11. Privacy
How we handle your information is set out in our Privacy Policy, which forms part of these terms.
12. Changes
We may update these terms. The version published on this page at the time you use the site is the version that applies, and the "last updated" date above will change when we do.
13. Which law applies
These terms are governed by the laws of the State of South Carolina, and the courts of South Carolina have jurisdiction over any dispute arising from them.

DMCA Copyright Notice
We respect other people's copyright, and we expect anyone using this website to do the same. This section explains how to report material you believe infringes your copyright, and how we respond.
Designated agent
Notices of claimed copyright infringement should be sent to our designated agent:
- Designated agent: John Duncan, Broker In Charge
- Email: johnduncan@upsidepropertysc.com
- Post: 1034 Wildewood Centre Drive, Suite A, Columbia, SC 29229
- Phone: (803) 319-6872
What your notice needs to contain
To be effective under 17 U.S.C. § 512(c)(3), a written notice must include substantially all of the following:
- Your physical or electronic signature.
- Identification of the copyrighted work you say has been infringed — or, if one notice covers several works on this site, a representative list of them.
- Identification of the material you say is infringing, with enough detail for us to find it — the URL or page, and where on the page it appears.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.
What we do next
On receiving a complete notice we will act expeditiously — normally by removing or disabling access to the identified material — and we will tell the person who posted it that we have done so.
If your material was removed and you disagree
You may send us a counter-notification under 17 U.S.C. § 512(g)(3). It must be written, signed, and include: identification of the removed material and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; and your name, address and telephone number, together with your consent to the jurisdiction of the federal district court for the district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who filed the original notice.
We may restore the material 10 to 14 business days after receiving a valid counter-notification, unless the original complainant tells us they have filed a court action.
Repeat infringement
We will terminate access for anyone we determine to be a repeat infringer.
Be aware before you file
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for the damages that results — including costs and attorneys' fees. If you are unsure whether material infringes your copyright, it is worth getting legal advice first.
Note to the site operator: the safe harbour in 17 U.S.C. § 512 only applies to a service provider that has a designated agent on file with the U.S. Copyright Office. Publishing this page is not the same as registering the agent — the registration must be filed at copyright.gov and renewed. The registration currently on file, or its absence, should be confirmed before relying on this section.
